Reminder of Changes in Procedure at the Landlord and Tenant Board


As of December 15, 2009, the grace period for those Landlords using the old Notice of Termination for Non-Payment of Rent (N4) has expired.  Landlords who give a notice for non-payment of rent after this date must use the revised N4 notice.  The new notice was prompted by a minor change made to the wording on the Notice (the explanation as to the amount the tenant must pay to avoid termination has been reworded).  The revised notice is available here on the Landlord and Tenant Board’s website.  Failure to use the revised


form could result in your application for eviction being dismissed.  Today I met with a tenant who was served with a form dating back to 2001 (which would have meant that the landlord would have to start the process all over again had the tenant not already moved out because of flood damage).  I recommend that you always go to the Board’s website to get the most current version of any form. 

The Landlord and Tenant Board monetary jurisdiction increased from $10,000 to $25,000 on January 1, 2010 to reflect the increased monetary jurisdiction of the Small Claims Court.  This means that if an application is filed on or after this date, the maximum amount that the Board can order paid to a party, or order as an administrative fine, will be $25,000.
